JUSTICE MADHURESH PRASAD ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 304B and 201/34 of the IPC.

Counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence and has falsely been implicated in this case due to ulterior motive. Petitioner has got no criminal antecedent and entire allegation is false and fabricated.

He further submits that the petitioner is mother-in-law of the deceased and there is no specific allegation against her. Petitioner is in custody since 06.06.2019.

Learned A.P.P. opposes the prayer for bail.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Bettiah, West Champaran in Bairiya P.S. Case no. 175/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
