The petitioner seeks bail in connection with Baniyapur P.S. Case No.244 of 2018 registered under Section 366(A) of the Indian Penal Code.

The accusation is that the daughter of the informant, aged about 17 years, moved from the house in the evening of 14.07.2018 to attend the call of nature but she did not return. In course of her search, the informant came to know that his daughter has been kidnapped by Shailesh Singh (petitioner), who asked the informant that his daughter would be sent to the house safely.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.67290 of 2019(4) dt.17-02-2020 2/2 submits that, in fact, the daughter of the informant moved from her house according to her own sweet will with Raju Singh and performed the marriage with him, which has come in the statement of the daughter of the informant, as recorded under Section 164 of the Code of Criminal Procedure on 24.12.2019. At the time of recording her statement, the age of the daughter of the informant has been assessed as 23 years by the Judicial Magistrate, First Class, Saran. The petitioner is in custody since 22.07.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, saran at Chapra, in connection with Baniyapur P.S. Case No.244 of 2018.
