JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2023 At the outset, learned counsel for the petitioner seeks permission to withdraw anticipatory bail application with respect to petitioner No. 10 namely Akshay Lal Singh @ Akshaylal
Patna High Court CR. MISC. No.74378 of 2022(2) dt.27-03-2023 2/3 Permission is granted.
The anticipatory bail application with respect to petitioner No. 10 namely Akshay Lal Singh @ Akshaylal is dismissed as withdrawn.
Heard the parties.
Petitioner Nos. 1, 2, 3, 4, 5, 6, 7, 8 and 9 apprehend arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of Arms Act.
As per prosecution case, on the alleged date and time, these petitioners entered into the house of the informant and open fired on the sister-in-law of the informant. It is further alleged that they also assaulted father and brother of the informant as a result of which they sustained injury. Learned counsel appearing for the petitioners submits that on account of land dispute, occurrence of simple maar peet took place. Case and counter case. Both sides sustained injuries and injuries. Doctor has found the injuries to be simple in nature. Furthermore, similarly situated co-accused person has already been granted bail by coordinate Bench of this Hon'ble Court vide order dated 23.02.2023 passed in Cr. Misc. No. 61312 of 2022.
Considering the aforesaid facts and circumstances, let
Patna High Court CR. MISC. No.74378 of 2022(2) dt.27-03-2023 3/3 the above named Petitioner Nos. 1, 2, 3, 4, 5, 6, 7, 8 and 9 in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in Udwantnagar P. S. Case No. 168 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
