JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Earlier prayer for anticipatory bail of the petitioner was allowed by order dated 28.8.2019 passed in Cr.Misc.No. 32669 of 2019 with direction to the petitioner to appear before the court below on 13.9.2019. However, it appears that he has not surrendered and filed this application for modification of the said order on the ground that due to inadvertence he could not surrender in time and now he is ready to surrender if some reasonable time is granted to him.

Heard learned APP also.

Having considered the callous attitude of the petitioner that he could not surrender within the time specified, I am not inclined to interfere with the earlier order passed by this

Patna High Court CR. MISC. No.74947 of 2019(2) dt.29-01-2020 2/2 Court. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit. This application is, accordingly, dismissed.
