====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 09-01-2019 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Kadam Kuan P.S. Case No. 337 of 2018, instituted for the offence under Sections 364(a) and 120(B)/34 of the Indian Penal Code.

Counsel for the petitioners submits that petitioners are not named in the written report.

In the written report the informant has alleged that his driver Mukesh Singh along with his associates Jamil Akhtar Subhani and 5-6 other accused persons took father of the informant for visiting Rajgir, Mundeshwari and Deo who has been kidnapped. It is further alleged that from Mobile of his father, the driver Mukesh Singh informed that 5-7 persons captured his father. He told the informant to deliver Rs.5,00,000/- otherwise his father would be killed. It is further alleged that Mukesh Singh, Jamil

Patna High Court Cr.Misc. No.74212 of 2018(3) dt.09-01-2019 2/2 Akhtar Subhani along with their associates in conspiracy with each other have kidnapped his father for ransom.

Counsel for the petitioners submits that petitioners have been arrested by the police during investigation on the basis of his name being disclosed by co-accused and, thereafter, the Police has recorded confessional statement of the petitioners. No Test Identification Parade has been held. The other co-accused with similar allegation has been granted bail by this Court vide order dated 5.11.2018 passed in Cr. Misc. 65654 of 2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kadam Kuan P.S. Case No. 337 of 2018, with subject to the condition that both the bailors will be the close relatives of the petitioners.
