The petitioner seeks bail in Danapur P.S. Case No. 123 of 2016, instituted for the offence under Section(s) 498(A), 323, 307/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
Petitioner is husband of the deceased.
In the written report it is alleged that sister of the informant was married with petitioner. The sister of the informant was pregnant and she was in her Naihar. It is further alleged that on 17.3.2016 the informant had gone to market. Petitioner after finding sister of the informant alone in the house, assaulted her with fists and slaps, on account of which, she became unconscious. Thereafter, petitioner admitted her in
Patna High Court Cr.Misc. No.75479 of 2018(3) dt.17-01-2019 2/2 hospital and fled away.
Case diary has been received.
Post mortem report is available in the case diary. The cause of death could not be ascertained by the Doctor in the post mortem report and viscera has been preserved. From the written report it appears that informant was in Naihar on the alleged date of occurrence. There is general and omnibus allegation against the petitioner that he assaulted sister of the informant in her Naihar after finding her alone in the house.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Danapur P.S.
