This application for anticipatory bail arises out of Barbigha P.S. Case N0. 117 of 2019, disclosing offences under Sections 302,328,120B of the Indian Penal Code. The petitioner is father-in-law of the deceased. Learned counsel appearing on behalf of the petitioner has submitted that the in-laws have been made accused for the unnatural death of the deceased on the basis of certain information which the informant is said to have gathered from co-villagers. He contends that there is nothing specific as to who disclosed to the informant that the in-laws were responsible for killing of the deceased. On perusal of the First Information Report, I find substance in the submission made on behalf of the petitioner. The informant is said to have received

Patna High Court CR. MISC. No.70528 of 2019(2) dt.27-11-2019 2/2 information regarding killing of the deceased in a particular way, without disclosing the source of such information. Considering the facts and circumstances of the case, this application is allowed.

Let the petitioner above named in the event of her arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in Barbigha P.S. Case No. 117 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
