====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nautan P.S. Case No. 496 of 2017, instituted for the offence under Sections 302, 201 and 120B of the Indian Penal Code.

In the written report it is alleged that informant got information on telephone that his nephew Mukesh Kumar is lying unconscious near Beli Mai Asthan. The informant along with his brother Ashok Sah reached there and found his nephew lying dead. They also found one girl lying there in injured condition. She was screaming. The informant found this petitioner and other accused persons as named in the written report, at the place of occurrence.

Counsel for the petitioner submits that it is

Patna High Court Cr.Misc. No.74348 of 2018(3) dt.11-01-2019 2/2 mentioned in the written report that deceased has developed love affairs with Noorjahan Khatoon who was daughter of this petitioner. The wife of petitioner lodged counter case against the informant for committing murder of her daughter Noorjahan Khatoon.

In the written report only suspicion has been raised against the petitioner of committing murder of nephew of the informant. He was having love affairs with daughter of this petitioner.

Petitioner is in custody since 29.11.2017 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 496 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
