Petitioner apprehends his arrest in Bihta (Neora O.P.) P.S. Case No.554 of 2017 registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Ankit Kumar in Bihta (Neora O.P.) P.S. Case No.654 of 2017. Save and except this case in which the name of the petitioner surfaced on the basis of confession, there is no other criminal case pending against the petitioner.

Considering the fact that the petitioner has already been granted anticipatory bail in which Ankit Kumar confessed and disclosed that the petitioner also committed theft in the

Patna High Court Cr.Misc. No.74126 of 2018(3) dt.09-01-2019 2/2 present case, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Danapur, District Patna in connection with Bihta (Neora O.P.) P.S. Case No.554 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
