The petitioner seeks bail in Kadamkuan P.S. case No. 493 of 2019 registered under Section 448, 354, 323, 341, 504, 506/34 of the IPC.
The petitioner and one Aman Kumar are said to have entered into the house of informant and behaved indecently with her. They also torn her under garments and when her husband came to rescue both the accused persons assaulted him. On alarm, may persons came. The petitioner and Aman Kumar were apprehended by the police.
The learned counsel for the petitioner submits that the petitioner is in jail since 30.07.2019. The petitioner is accused in one case being Ganga Bridge PS case No. 15/2018 registered u/s 30(a) of the Bihar Prohibition & Excise Act. Some verbal
Patna High Court CR. MISC. No.72378 of 2019(3) dt.11-12-2019 2/2 altercation took place between the petitioner and the informant but the informant implicated the petitioner with exaggerated version.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for more than four months, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XII, Patna in connection with Kadamkuan P.S. case No. 493 of 2019.
