Petitioner apprehends his arrest in Barh P.S. Case No. 260 of 2017 instituted for the offence under Section(s) 302, 120(B)/34 Indian Penal Code and Section 27 of the Arms Act, is pending in the Court Additional Chief Judicial Magistrate, Barh, Patna.
Prayer of the petitioner for grant of anticipatory bail was rejected earlier by this Court on merit by order dated 21.06.2018 in Cr. Misc. No.26115 of 2018.
Counsel for the petitioner submits that one of the accused, Rajesh Kumar, has been granted anticipatory bail by this Court vide order dated 28.03.2018 passed in Cr. Misc. No.10143 of 2018. He further submits that one of the accused,
Patna High Court Cr.Misc. No.76768 of 2018(3) dt.09-01-2019 2/2 Monu Kumar @ Monu Singh @ Monu has been granted regular bail by order dated 27.08.2018 passed in Cr. Misc. No.38850 of 2018, which have been annexed as Annexure-5 series. This Court finds that case of accused, who was granted anticipatory bail by this Court vide order dated 28.03.2018 passed in Cr. Misc. No.10143 of 2018, was on different footing with the case of this petitioner. The prayer of the petitioner for anticipatory bail has already been rejected on merit by this Court. Therefore, this Court does not find any new ground to grant anticipatory bail to petitioner.
Accordingly, the prayer for anticipatory bail of petitioner is, again, rejected.
Petitioner is directed to surrender in the Court below within six weeks from the date of receipt of this order and make prayer for regular bail which will be considered by the Court below in accordance with law, without being prejudiced by this order.
