JUSTICE SANJAY PRIYA ORAL ORDER 11-01-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Kanhauli P.S. Case No. 38/2018, instituted for offences under Section(s) 341, 323, 326, 354, 307, 506/34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence at 12 O' clock in the night, father-in-law of informant along with Santosh Rai entered into her house and attempted to commit rape with her. She raised alarm then accused persons caught hold her and took her outside from the house. They brutally assaulted her and poured acid on her whole body causing injury.
Injury report is available in case diary, which shows that victim has sustained severe burn injury caused by acid.
Patna High Court Cr.Misc. No.74713 of 2018(3) dt.11-01-2019 2/2 From the injury report, it appears that informant has sustained burn injury with acid about 75 %.
Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.
