JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 13-11-2024 In the instant petition, petitioner has prayed for the following relief(s):- (I)For issuance of a writ in the nature of a writ of mandamus commanding the respondent authorities to ensure peaceful physical possession of his Raiyati land situated at plot No -6801 in Khata no 409, In mauja - Datiyana, P. S. - 63 Bikram Dist.- Patna over

Patna High Court CWJC No.17175 of 2024 dt.13-11-2024 2/3 which house of petitioner existing but forcibly being encroached by bad elements in respect of which the petitioner gave detailed representation dated 12/03/2024 to C O Bikram and representation dated 13/08/2024 to DCLR paliganj (Patna) but of no avail because of which the petitioner suffering irreparable damage as the bad elements has even demolished construction part of house in the northern part of the plot.

Learned counsel for the petitioner submits that petitioner was in the physical possession of Raiyati land situated at Plot No. 6801 in Khata No. 409, In mauja - Datiyana, P.S. - 63 Bikram, District - Patna over which the house of the petitioner was existing and some bad elements have encroached upon the said house of the petitioner. Learned counsel submits that petitioner has represented before the Circle Officer, Anchal Bikram, Patna as well as the Deputy Collector Land Reforms (DCLR) Patna, but no action has been taken. Learned counsel for the petitioner submits that official receipt of the said representation before the DCLR, Patna is mentioned on the representation annexed as Annexure P/3 to the writ petition.

3. Learned counsel for the State submits that

Patna High Court CWJC No.17175 of 2024 dt.13-11-2024 3/3 petitioner may file fresh representation and the concerned authority will look into the matter.

4. Considering the facts and circumstances of the case and the arguments advanced on behalf of the parties, the instant writ petition stands disposed of with the direction that petitioner may file fresh representation before the appropriate authority within six weeks from the date of receipt of this order. If petitioner submits his representation before the concerned authority within the stipulated period, the competent authority is directed to hear the grievance of the petitioner and pass order expeditiously, preferably, within eight weeks from the date of receipt of this order in accordance with law.
