The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 30(a) read with section 13 of the Bihar Prohibition and Excise Act, 2016.
As per the allegation in the FIR, 60 litres of country made wine is said to have been recovered from the house of the petitioner. It is further stated that the petitioner managed to escape.
It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place, the petitioner has not been caught at the place of occurrence, he has no criminal antecedent and is in custody since 27.08.2019. The application for bail has been opposed by learned APP
Patna High Court CR. MISC. No.73240 of 2019(2) dt.25-11-2019 2/2 for the State.
Having heard learned counsel for the parties and taking into consideration the above stated facts, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Katihar in connection with Manihari P.S. Case no. 108 of 2019 (District Katihar).
