The petitioner apprehends his arrest in Khusrupur P.S. case No. 3 of 2001 registered under Section 302, 201/34 of the Indian Penal Code. Later on Section 396 and 412 of the IPC were added.

The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of co-accused but it appears that the case is of the year 2001. Three persons were killed and their dead bodies were thrown into a river. The name of petitioner surfaced during the course of investigation that petitioner was also one of the accomplices. The petitioner was absconding.

Considering the facts aforesaid and nature of

Patna High Court Cr.Misc. No.74774 of 2018(3) dt.09-01-2019 2/2 allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
