JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Jamui P.S. Case No. 185/2018, instituted for offences under Section(s) 364/120(B) of the Indian Penal Code.

It is alleged in the written report that on 03.04.2018, husband of informant was called on telephone by Mithu Tanti to go to Deoghar for purchasing Marble. Mithu Tanti asked the husband of informant to come to Jamui. Thereafter husband of informant went to Jamui and since then he is missing. It is further alleged that husband of informant was working in Tamilnadu with this petitioner as Mistri. This petitioner was contractor there. Some altercation had taken place between them for payment of wages. This petitioner had given threat of dire

Patna High Court Cr.Misc. No.75932 of 2018(3) dt.21-01-2019 2/2 consequences to the husband of informant. On the basis of aforesaid threat informant has raised suspicion against this petitioner.

Learned counsel for the informant has submitted that petitioner is relative of co-accused Mithu Tanti. The counsel for petitioner has stated that petitioner has denied about any relationship with Mithu Tanti in para 8 of this petition. The informant has raised mere suspicion against the petitioner.

Petitioner is in custody since 21.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 185/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
