The petitioners apprehends their arrest in a case registered for the offences punishable under Sections 115 (2), 126 (2), 109 and 3 (5) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

All the F.I.R. named accused persons including these petitioners in furtherance of their common intention armed with deadly weapons are said to have assembled and co-accused, Virendra Kumar resorted firing which hit at knee of the left leg of the informant. Other co- accused including the petitioners also resorted firing which got misfired. The reason behind the occurrence is said to be land dispute.

It is submitted by learned counsel for the petitioners that no

Patna High Court CR. MISC. No.81177 of 2024(4) dt.07-03-2025 2/2 such occurrence as alleged ever took place. They have been falsely implicated in this case due to previous grudge and land dispute. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. Petitioners are only said to be the members of mob. Both the parties are closed agnates and there is admitted land dispute between them. Petitioner no.1 has two criminal antecedents and petitioner no.2 has no criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Gaurichak P.S. Case No. 372 of 2024, subject to the condition as laid down under Section 482 (2) Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. (Anjani Kumar Sharan, J) shikha/- U T
