Petitioner seeks regular bail in connection with N.D.P.S. Case No.33 of 2018, arising out of Patahi P.S. Case No.108 of 2018, for the offence punishable under Sections 20 and 22 of N.D.P.S. Act.

The allegation against the petitioner is that police intercepted the petitioner and recovered a total quantity of 140 gram of Ganja from his possession.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Learned counsel for the petitioner further submits that recovered Ganja does not come under the commercial quantity and he is in

Patna High Court CR. MISC. No.70682 of 2019(2) dt.04-12-2019 2/2 custody since 04.06.2018. Learned counsel further submits that the petitioner has falsely been implicated in other case after being arrested on the basis of confessional statement made by the accused persons, as assertion made in paragraph No.3 of the bail petition.

Having regard to the submissions made by the parties and taking into consideration the fact that small quantity of Ganja has been recovered from the possession of the petitioner and the petitioner is in custody since 04.06.2018, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge/Special Judge, East Champaran at Motihari, in connection with N.D.P.S. Case No.33 of 2018, arising out of Patahi P.S. Case No.108 of 2018.
