JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Patori P.S. Case No. 350 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 1.860 litres of liquor from Bhusa Ghar of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the house is joint house.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that there is recovery of liquor from the house of the petitioner and he is accused in another

Patna High Court CR. MISC. No.67165 of 2019(3) dt.18-11-2019 2/2 case of similar type.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
