JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 366A/ 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of the informant for illicit purposes.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that petitioner has been made accused in this only because he is brother of main accused, Satyam Kumar. The victim in her statement u/s 164 of the Cr.P.C. has not supported the prosecution case and denied the

Patna High Court CR. MISC. No.75115 of 2022(3) dt.19-05-2023 2/2 involvement of this petitioner. Similarly situated accused Devendra Singh has already been granted bail by a co-ordinate Bench of this court vide order dated 28.04.2023 passed in Cr. Misc. No. 70463/ 2022. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and the statement of victim recorded u/s 164 of the Cr.P.C. coupled with clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha PS case No. 79/ 2022, subject to conditions laid down u/s 438(2) of the Cr.
