The petitioner is in custody since 20.09.2019 in connection with Excise Case No. 418 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather the same has been recovered from the hut.
