2. The petitioner apprehends his arrest in a case registered for the offence under Sections 457 and 380 of the Indian Penal Code and Sections 25(1-B)a/26 of the Arms Act.

3. Pursuant to Court's order dated 21.03.2024 and 24.04.2024, the S.P. Nalanda at Biharsharif has furnished a report, which is kept at flag 'B', and from perusal of the same, it appears that since petitioner himself was seriously injured in the alleged occurrence and was under-treatment in different hospitals, he could not be arrested and therefore, petitioner has filed the present petition for grant of anticipatory bail.

4. Learned counsel for the petitioner submits that as a matter of fact, the petitioner is a Prakhand Teacher and due to dispute with some students over petty issue, a scuffle took place

Patna High Court CR. MISC. No.79255 of 2023(7) dt.03-07-2024 2/2 and petitioner himself got seriously injured, for which, he lodged an F.I.R., vide Sarmera P.S. Case No. 110 of 2023 against informant and others and only with a view to save skin from that, the present case has been lodged. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the fact that there is case & counter case and petitioner also sustained injury couple with the fact that petitioner is Prakhand Teaching, having clean antecedent, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 109 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
