JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 317/2020 & Pocso Case No. 148 of 2022, registered for the offence punishable under Sections 366A/34 of the Indian Penal Code. As per prosecution, informant's daughter was taken away by the brother of the petitioner. There was love affairs between the petitioner's brother and the victim girl. Learned counsel for the petitioner submit that the petitioner is quite innocent and has falsely been implicated in this case. Similarly situated person has already granted bail by this Hon'ble Court vide order dated 27.05.2021 passed in Cr. Misc. No. 5921 of 2021. Petitioner is in custody since

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Session Judge, VI, Bhagalpur cum Special Judge, POCSO Act, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 317/2020 & Pocso Case No. 148 of 2022.
