Petitioner seeks bail in a case registered for the offence punishable under Sections 414, 415, 364, 379, 411 and 379 of the Indian Penal Code.
Four F.I.R. named accused persons are said to have stolen the truck and given it to Ajam Mistry for repairing and the said truck was seized from roadside.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has committed no offence. He has been falsely implicated in the case. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the confessional
Patna High Court Cr.Misc. No.74912 of 2018(3) dt.06-02-2019 2/2 statement of co-accused Sabbal Rai. Petitioner had no knowledge of lodging of the case against him rather he came to know the same through the publication made by the police. Similarly situated co-accused namely Sagar Yadav has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 01.12.2009 passed in Cr. Misc. No. 40853 of 2009. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Nalanda, Biharsharif in connection with Laheri P.S. Case No. 02 of 1997.
