The petitioner seeks bail in Katoria P. S. Case No. 151 of 2019 instituted for the offence under Section(s) 379 of the Indian Penal Code. Later on Section 411 of the I.P.C. was added. Having no criminal antecedents, it is submitted that petitioner has been implicated in this case merely on suspicion as he was a bona fide customer in the line hotel of the informant. Even as per the case diary, there is a contradiction, as regards, the recovery of battery. Even that cannot be attributed to the petitioner. Petitioner is in custody since 19.08.2019. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.68834 of 2019(2) dt.04-12-2019 2/2 each to the satisfaction of the Judicial Magistrate 1st Class, Banka, in connection with Katoria P. S. Case No. 151 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
