2. The petitioners apprehend arrest in connection with Daudnagar P.S. Case No. 444 of 2023, dated 20-07-2023, instituted for the offence punishable under Sections 147,149,341, 323, 354, 504 and 506 of the Indian Penal Code.
3. There is allegation of taunting and eve teasing the girl students of the school against the petitioners. It is further alleged that on protest, they become violent and ready to fight. Further allegation is that on 19-07-2023, all the petitioners came in the
Patna High Court CR. MISC. No.76563 of 2023(2) dt.29-11-2023 2/3 field of Ashok Inter School and assaulted the students of the school, on account of which, some of the students sustained serious injuries.
4. Learned counsel for the petitioner submits that petitioner No.1 is father of petitioner Nos. 2 and 3. It is further submitted that on account of trivial dispute over playing cricket in the field of other school, scuffle took place among the boys of two groups and there was a free fight between them and just to make the case serious in other way the allegation has been made towards taunting and eve teasing the girls, which is not true due to non-availability of injury report on record as well as the statement of any girl students of the said school. It is submitted that the allegation of taunting the girl is neither supported by cogent material or statement of any girl student. It is next submitted that the allegation appears to be general and omnibus in nature and none of victim sustained injury. As per disclosure made in para 3 of the bail petition, petitioner Nos. 1 and 3 have got no criminal antecedent whereas there is one case pending against petitioner No.2 since before.
5. Learned A.P.P. for the State has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the
Patna High Court CR. MISC. No.76563 of 2023(2) dt.29-11-2023 3/3 case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Daudnagar P.S. Case No. 444 of 2023, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM Aurangabad, subject to condition as laid down under Section 438(2) of the Cr.P.C.
