This is an appeal under Section14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by order dated 11.04.2018 passed by the learned Addl. Sessions Judge-I-cum-Special Judge, Katihar in connection with Barsoi P.S. Case No.129/2014 registered under Sections 326A/307 of the Indian Penal Code and later on Section 302 was also added and Sections 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Allegation against the petitioner is to have thrown acid upon the body of the mother of the informant as a result of which she died during treatment.

Patna High Court CR. APP (SJ) No.4349 of 2018(8) dt.13-03-2019 2/2 It has been submitted on behalf of the appellant that he is innocent and has falsely been implicated in this case. Appellant has no criminal antecedent and he is in custody since 03.09.2014.

Considering the nature of allegation and that Trial is on verge of conclusion, I am not inclined to enlarge the appellant on bail at this stage. Hence, the prayer for bail of the appellant is hereby rejected.

However, Trial Court is directed to conclude Trial within three months.
