2. Learned counsel for the petitioner sought permission to make some necessary correction in para-10 of his petition.

3. Permission is accorded.

4. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

5. As per prosecution case, some unknown persons came on a motorcycle and having katta in their hand, restrained to the informant and his brother. It is further alleged that they assaulted them and snatched bag containing jewellery, two gold rings and cash of Rs. 40,000/-.

6. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.81470 of 2023(3) dt.19-03-2024 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is submitted that a scuffle took place between both the parties due to previous enmity and petitioner has been dragged in this case. Nothing incriminating article has been recovered from the conscious possession of the petitioner. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 14.09.2023 in Cr. Misc. No. 60669 of 2023. Moreover, the petitioner is languishing in judicial custody since 28.04.2023.

7. Learned APP appearing for the state has opposed the prayer of regular bail.

8. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Akorhigola P.S. Case No. 25 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Dehari.
