JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 68 of 2018, arising out of Nadi P.S. Case No. 127 of 2018 for the offence under Sections 8/20/22/25 and 29 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner is in custody since 08.07.2018. Learned counsel further submits that the petitioner is the driver of Tempo. He further submits that in the instant case 18 Kg. Ganja was recovered from the said Tempo.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than five months and also the fact that the recovered Ganja is

Case No. 127 of 2018.
