JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody since 21.7.2018 in connection with Fatehpur P.S. Case No. 371 of 2017 for the offenses under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case other co-accused persons, namely, Anil Yadav, Bhola Yadav and Ankit Kumar have been granted bail vide orders dated 5.3.2018 26.9.2018 and 2.11.2018 in Cr. Misc. Nos. 8121, 47861 and 65579 of 2018 respectively. Considering the fact that similarly circumstanced others have been granted bail, let the petitioner, above named,

Patna High Court Cr.Misc. No.77166 of 2018(3) dt.10-01-2019 2/2 be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM X, Gaya in connection with Fatehpur P.S. Case No. 371 of 2017.
