The petitioner apprehends his arrest in connection with Cheriya Bariarpur P.S. Case No.48 of 2019, registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.
The petitioner is said to have kidnapped the daughter of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the statement of the victim was recorded under Section 164 Cr.P.C. in which she has not supported the prosecution case. The
Patna High Court CR. MISC. No.75206 of 2022(2) dt.07-02-2023 2/2 victim girl clearly stated in her statement recorded under Section 164 Cr.P.C. that she solemnized marriage with the petitioner and she wants to live with the petitioner in her in-laws house.
Considering the statement of the victim recorded under Section 164 Cr.P.C., let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheriya Bariarpur P.S.
