Mr. Akshay Lal Pandit ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Bakhtiyarpur P.S. Case No. 275 of 2018 for the offences under Sections 341, 323, 325, 307, 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 12.06.2018. He further submits that with reference to the case diary materials have come to indicate that the allegation against the petitioner is that he has assaulted the informant with iron rod.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand)

Patna High Court Cr.Misc. No.74034 of 2018(3) dt.29-01-2019 2/2 with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 275 of 2018. However, the Court below is directed to expedite the trial of this case and conclude the same within a period of nine months from the date of receipt/production of copy of this order. In the event that petitioner is found involved in delaying the trial and influencing the witnesses, the Trial Court shall be at liberty to cancel the bail bond of the petitioner.
