2. This application, for grant of anticipatory bail, arises out of Sherghati Police Station Case No.1028 of 2023, dated 29.09.2023, disclosing offences under Sections 147, 341, 323, 504, 307 and 506 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that petitioner along with 15-20 unknown persons armed with Iron Punja and rod assaulted the informant and his friend due to which they sustained injuries.

4. Learned Counsel for the petitioner submits that the occurrence took place due to some scuffle in the Gym and the allegation is that petitioner along with his friend while returning from Gym, assaulted the informant and others. Referring to

Patna High Court CR. MISC. No.77707 of 2024(2) dt.21-11-2024 2/2 injury report annexed at Annexure 2, learned counsel submits that the injuries caused to victims are simple in nature by hard and blunt substance.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation which is general and omnibus and the injuries caused to victims are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Sherghati Dist.-Gaya, in connection with Sherghati Police Station Case No. 1028 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
