The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that on 06.11.2012 at 6 p.m. the informant heard sound of fire arms, then he came out from the house and reached near the house of Sano Mistry saw that accused persons were pulling her husband from the house of Salo Mishtri. When the accused persons saw the informant, they fled away locking the house of Salo Mistri. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.02.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.66609 of 2019(3) dt.19-11-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner. Other co-accused has been granted bail vide Cr.Misc.No.20070 of 2014.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sumit Kumar Singh, Judicial Magistrate, 1st class, Gaya in connection with Civil Lines P.S. case No.407 of 2012.
