Petitioner is apprehending his arrest in connection with Kotwali P.S.Cae No.436/19 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act Petitioner happens to be owner of the vehicle and from that there is recovery of liquor .

Submission of the learned counsel for the petitioner is that one Manoj Kumar was arrested from the spot and he was not present there and he has been made accused only because he is owner of the vehicle, which was found in damaged condition by the police. He has no criminal antecedent and he is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

No.67143 of 2019(2) dt.24-10-2019 2/2 2019 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Kotwali P.S.Case No.436 of 2019 subject to conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
