====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 379, 411/34 of the IPC and 37 (C) of the Bihar Prohibition and Excise Act, 2016.

The prosecution story, in brief, is that the petitioner and others was caught red handed on the spot with the stolen battery which was recovered from the Tempo brought by them to commit theft. The petitioner was also found in drunken stage. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 31.07.2019. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against

Patna High Court CR. MISC. No.73480 of 2019(2) dt.18-11-2019 2/2 the petitioner. The petitioner is said to have arrested in drunken condition. The allegation of committing theft is denied by the petitioner. He has been made accused in the present case due to mistake of fact.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Purnea, in connection with Special Case No. 584 of 2019, arising out of K. Hat P.S. Case No. 541 of 2019.
