This is an application for regular bail on behalf of the petitioners for the offences alleged under Sections 341, 323, 504, 279, 307, 506, 324, 354 and 34 of the Indian Penal Code registered in connection with Ramgarh P.S.Case No. 368 of 2022.

The learned counsel for the petitioners has submitted that there is case and counter case. The petitioners are persons of clean antecedents and other co-accused persons have been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.2378 of 2023. He has submitted further that both the parties have sustained injuries and the allegation against the petitioners are general and omnibus. They are in custody since 26.10.2022.

No.1867 of 2023(2) dt.05-04-2023 2/2 Considering the above facts and circumstances, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sub-divisional court Mohania, Kaimur at Bhabua in connection with Ramgarh P.S.Case No. 368 of 2022, subject to the following conditions:-

1. The petitioners shall cooperate in the disposal of trial and make available available as and when required by the court.

2. If the petitioners is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
