Petitioners apprehend their arrest in connection with Abadpur P.S.Case No. 4 of 2018 registered for the offences punishable under Sections 341, 323, 325, 307, 504, 379, 506, 448 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the daughter of the informant, causing injuries to her. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and no specific allegation of assault is attributed to them.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail. Having heard both sides and in the facts and

No.14871 of 2018 (3) dt.23-04-2018 2/2 circumstances, specially in view of the fact that there is no specific allegation against them, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Ms. Jai Shree Kumari, Judicial Magistrate, 1st Class, Katihar, in connection with Abadpur P.S.Case No. 4 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
