2. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 498A, 494, 406, 504, 506/34 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.

3. The case is one under section 498A and the petitioner is the husband. The allegation made in the complaint is with regard to demand of dowry and torture.

4. The matter had been sent to the Mediation Center , Patna High Court for reaching an amicable settlement between the parties. The mediation report is on the record, which would go to show that the issues have been resolved between the

No.79247 of 2024(4) dt.18-06-2025 2/3 parties vide memorandum of agreement dated 16.05.2025 passed in Mediation Proceeding No. 565 of 2025 whereby the understanding has been reached that a total amount of Rs. 4,75,000/- would be paid by the petitioner to the opposite party no. 2 in three equal installments. The first installment of Rs. 1,58,333/- would be paid before furnishing the bail bond. Today, it has been submitted that there is a technical problem in maintaining the first date of installment as neither the petitioner nor the opposite party no. 2 has a bank account. However, it has been submitted on behalf of the learned counsel for the informant that he would be furnishing a bank account number of any of the relative of the opposite party no. 2, in which the money can be transferred.

In such view of the matter, let the petitioner in the event of his arrest/ surrender within a period of four weeks from today be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Complaint Case No. 757C of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C and subject to the further condition that the

6. However, the receipt of payment of first installment of Rs. 1, 58,333/- would be produced at the time of furnishing of the bail bonds. It is expected that both the parties would strictly abide to the terms of the settlement and would cooperate each other and the opposite party no. 2 would take steps to withdraw the criminal case as well as maintenance case which she has filed against the petitioner.
