Petitioner apprehends his arrest in connection with Laxmipur (Gidhour) P.S.Case No. 124 of 2017, G.R.No. 1285 of 2017, registered for the offences punishable under Sections 147, 148, 341, 323, 307, 427, 504 and 506 of the Indian Penal Code. Allegation against the petitioner is of assault by iron rod on the head of informant, causing grievous injury. Submission of learned counsel for the petitioner is that there is delay of one month in lodging of FIR and further there is dispute between the parties with respect to a piece of land and opinion on injury was kept reserved and after seven days of receipt of opinion this false and concocted case has been lodged. Patna High Court Cr.Misc. No.14886 of 2018 (3) dt.23-04-2018 2/2 regained his consciousness he has lodged this case, as such, there is delay.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.
