The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 148, 302, 427 of the Indian Penal Code.
As per F.I.R., husband of informant went outside of the house on a motorcycle but he did not return till night and in the morning, informant came to know that dead-body of her husband way lying at Sahni Tole where she came to know that petitioners alongwith 50-60 persons committed murder of husband of informant presuming his cattle thief. It is submitted on behalf of petitioners that informant
Patna High Court CR. MISC. No.74544 of 2022(2) dt.24-03-2023 2/2 is not eye-witness of the occurrence and has not disclosed the source of information. But only on suspicion, petitioners have been made accused in this case. During investigation, no cogent material has come against petitioner to show his complicity in the alleged crime. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 307 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
