JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-07-2018 Petitioner apprehends his arrest in connection with Khodawanpur P.S. Case No. 151 of 2011 registered for the offences punishable under Section 392 of the Indian Penal Code. Allegation as per FIR is that three persons have snatched Rs.36,000/-, pass book and I. Card of the informant and petitioner is not named in the FIR but during course of investigation his name transpired. From paragraph 3 of the petition it appears that petitioner has criminal antecedents of similar type of cases. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him. Heard learned APP also.
Having heard both sides and in view of accusation and criminal antecedents, I am not inclined to grant privilege of
Patna High Court Cr.Misc. No.17454 of 2018 (5) dt.02-07-2018 2/2 anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
