Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Mahindwara P.S. Case No. 92 of 2022 lodged under Sections 379, 413, 414 and 34 of the I.P.C.

As per the prosecution case, there are three named accused persons in the present case, including the present petitioner.

Learned counsel for the petitioner submits that allegation of theft and disposal of stolen property, is there in the F.I.R. against the petitioners and others.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.74161 of 2022(2) dt.25-03-2023 2/2 petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 19.06.2022, having clean antecedent. He further submits that other co-accused, who has been apprehended along with the petitioner has been granted bail vide order dated 07.02.2023 in Cr. Misc. No. 67503 of 2022 by the Co-ordinate Bench of this Court.

Learned counsel for the State opposes the prayer for bail and submits that the prosecution in which this case has been lodged, is Magisterial Triable.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Mahindwara P.S. Case No. 92 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
