JUSTICE ARUN KUMAR JHA ORAL ORDER 19-11-2025 Both the criminal miscellaneous petitions have arisen out of the same police station case number, hence they are being heard together and decided by a common order.

2. Heard learned counsel for the petitioners and learned A.P.P. for the State.

3. In the present case, the petitioners seek bail in

2/4 connection with Kargahar P.S. Case No. 172 of 2025 dated 04.06.2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2) and 317(2) read with Section 3(5) of the BNS.

4. As per prosecution case, petitioners and other coaccused persons assaulted the informant with iron-rod, lathi and danda causing a number of injuries to him. They also snatched rupees seventy-five thousand from the informant.

5. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in the present case. The occurrence is stated to have taken place on 25.05.2025, but the written report has been given on 04.06.2025 and this delay of 10 days has not been explained. Informant has not given any motive or reason for the occurrence, but there is counter case filed by the petitioners' side vide Kargahar P.S. Case No. 176 of 2025, which has been lodged by Tilaki Devi, wife of petitioner Guru Charan Ram. In the said occurrence, the petitioners' side has received injuries for which there is no explanation. Learned counsel further submits that moreover, injury report of the informant shows four injuries, but the injuries are laceration and abrasion. Three such injuries are simple in nature including one on the head of the informant

3/4 which is a lacerated wound of size 2" x 0.5cm x scalp deep over right occipito-temporal region of head. Injury over right leg of size 1" x 0.5cm has been found to be grievous due to fracture of distal phalanx. There is no allegation of assault against the petitioner Gur Charan Ram, but the allegation of assault against petitioner Dablu Ram is common with co-accused Deepak Ram, but the injury is stated to be simple. The petitioners are having antecedent of one case each and they are in custody since 22.08.2025.

6. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of injury and the period of custody of the petitioners, the petitioners, above-named, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram at Rohtas / concerned Court, in connection with Kargahar P.S. Case No. 172 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the

(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioners on single date or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the Court concerned.
