1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Kotwa P.S. Case no. 76 of 2024 registered under sections 307, 323, 385, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, co-accused Chuttun Singh along with the petitioner herein are said to have come and made a demand of rangdari of Rs.5 lacs from the informant. It is further stated that on the informant protesting, Chuttun Singh struck him with a glass bottle on his head leading to injuries.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged has taken place. For the sake of argument accepting the allegations levelled in the F.I.R., the allegation of assault etc. are on Chuttun Singh who has been enlarged on

Patna High Court CR. MISC. No.78435 of 2024(2) dt.28-11-2024 2/2 regular bail vide order dated 4.6.2024 passed in Cr. Misc. no. 39882 of 2024. The petitioner has no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R., grant of regular bail to co-accused vide aforesaid order dated 4.6.2024 and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Kotwa P.S. Case no. 76 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateX, East Champaran, Motihari.
