2. Petitioner seeks regular bail in connection with Rajiv Nagar P. S. Case No. 725 of 2024 in a case registered for the offences punishable under Sections 103(1) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 27.11.2024 at around 6:00 PM informant received a call from the petitioner that her daughter has committed suicide by hanging and told her that she can get information from Rajiv Nagar Road No.21. When informant again wanted to contact the petitioner, he switched off his mobile phone. Thereafter, informant gave
Patna High Court CR. MISC. No.74992 of 2025(2) dt.13-11-2025 2/3 information to Rajiv Nagar Police Station and she along with her relatives reached Rajiv Nagar Road No.21. She found her daughter hanging with fan. After verifying from the landlord of the said house, she learnt that her daughter (deceased) and the petitioner, after performing marriage were living since two months. Informant further states that on 26.11.2024 she last talked her daughter on phone when she was nervous. Informant believes that the petitioner has hanged her daughter after killing her
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner has neither solemnized marriage with the deceased nor he was dwelling with the deceased. The police after investigation submitted charge-sheet under Section 108 of the B.N.S. The petitioner has clean criminal antecedent and he is in custody since 27.05.2025.
5. Learned APP for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation that the petitioner mounted pressure on the daughter of the informant as a result of which she committed suicide. It is further submitted that the prayer for anticipatory bail application of the petitioner had already been rejected by
Patna High Court CR. MISC. No.74992 of 2025(2) dt.13-11-2025 3/3 this Court vide order dated 15.05.2025 passed in Cr. Misc. No. 8355 of 2025.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- II Patna/concerned Court below in connection with Rajiv Nagar P. S. Case No. 725 of 2024.
