Though the present writ petition has been filed seeking to challenge the order dated 08.03.2022 passed by the Arms Magistrate, Siwan, whereby and whereunder the arms license of the petitioner has been cancelled as also for quashing the appellate order dated 26.08.2022 passed by the learned Court of Commissioner, Saran Division, Chapra in connection with Arms Appeal Case No. 57 of 2022, however, the learned counsel for the petitioner seeks liberty on behalf of the petitioner

Patna High Court CWJC No.18489 of 2022(2) dt.03-07-2023 2/2 to file a fresh application for grant of arms license, however, seeks a direction upon the licensing authority to consider the fact that the petitioner is a retired army personnel. It is also submitted that the licensing authority be directed not to be prejudiced by the aforesaid orders dated 08.03.2022 and 26.08.2022, while considering the application of the petitioner for grant of arms license. Liberty, as sought for, is granted. 2.

It is needless to state that the respondent authorities, while considering the application, to be filed by the petitioner for grant of fresh arms license, shall not only consider the fact that the petitioner is a retired army personnel but shall also not be prejudiced by the aforesaid orders dated 08.03.2022 and 26.08.2022.

The writ petition stands disposed off on the aforesaid terms.
