2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 20 and 22 of the NDPS Act.

3. As per the prosecution case, petitioner and other accused persons were apprehended by the informant while they were fleeing away and in course of search, total 37.300 kilograms Ganja and mobile phones were recovered from their joint possession which was kept in ALTO Car.

4. Learned counsel appearing for the petitioner submits that the petitioner is neither owner nor driver of the vehicle in question. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Charge sheet has already been filed.

5. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Katihar in NDPS Case No. 26 of 2023, Balia Belone Police Station Case No. 82 of 2023.
