1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Chanpatia (Kumarbag) Police Station Case No. 486 of 2023, dated 07.08.2023, disclosing offences under Sections 341/323/324/307/379/504/506/34 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 12.07.2023, while the informant was sowing paddy in the field, all the accused persons came there and started abusing him due to previous land dispute and upon protest being made by the informant, the petitioner no. 1

Patna High Court CR. MISC. No.78650 of 2023(2) dt.10-01-2024 2/3 assaulted him by means of lathi and the petitioner no. 2 gave farsa blow on the head of the informant.

4. Learned counsel for the petitioners submits that both the parties are co-villagers and there is land dispute between them, which would be evident from First Information Report itself. He further submits that a counter case, bearing Complaint Case No. 2033 of 20233, has been lodged by the side of the petitioners. He next submits that the injury caused to the informant is simple in nature.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that there is land dispute between the parties, a case and counter is also there and injury caused to the informant is simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in
