The petitioner is in custody since 04.09.2019 in connection with Kotwa P.S. Case No. 134 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from behind the joint house of the petitioner. It is further submitted that the petitioner has no criminal antecedent.
